Criminal Penalties

First Offense

Minimum Sentence - 48 hours
Maximum Sentence - 6 months
Fine -$500 to $1,000

Second Offense

Minimum Sentence - 90 days (must serve 5, other 85 can be suspended)
Maximum Sentence - 1 year
Fine - $1,000 to $1,500

Third Offense

Minimum Sentence - 90 days (may be served by house arrest, work release, or inpatient treatment program)
Maximum Sentence - 1 year
Fine - $1,500 to $2,500

Fourth or Subsequent

Minimum Sentence - 90 days (may be served by work release)
Maximum Sentence - 1 year
Fine - $2,500

Driver's License

In addition to any criminal penalties you can face a suspension of your driver's license. The suspense can range from 1 year or be a lifetime suspense depending on your history. You have 10 days from the date of a test failure or test refusal to request an administrative hearing. If you fail to request a hearing your driver's license will be suspended.
